Stepparent Adoption of a Minor Package

For The People Stepparent Adoption of a Minor Package contains the standard forms needed for a stepparent to adopt the biological minor child (a child under the age of 18) of his or her spouse. The For The People Stepparent Adoption of a Minor Package contains the following forms:

  • Consent of Minor Child (if 14 years of age or older)

Depending upon the county in which you will be filing the Petition there may be additional required local forms; these are also included in your Package.

In a stepparent adoption of a minor, the parental rights of the parent who is not the child's custodial parent are terminated. The reason for the termination could be because the non-custodial parent has not had any contact with the child in many years, has failed to provide any financial support, or was never known to the mother of the child. Adoption then creates a legal relationship between the adopting parent and the child just as if the adopting parent and the child were biologically related.

For The People can only assist if the biological parents of the child agree to the adoption and are available to sign the necessary consent forms. If the minor child is over the age of 14, the child must also sign a consent form. Due to special laws and complexities, For The People cannot assist if the minor is of Native American or Native Alaskan heritage.
